Türk-İsviçre Borçlar Kanunu ve İsviçre Borçlar Kanunu (2020) Tasarısında Kusursuz Sorumluluk Hallerinin Görünümü

Abstract

İsviçre Borçlar Kanunu 1911’de yürürlüğe girmiş olup, sorumluluk hukukuna ilişkin olmak üzere Prof. Dr. Pierre Widmer ve Prof. Dr. Pierre Wessner tarafından hazırlanan tasarı kanunlaşamamıştır. İBK 2020 tasarısı ise genel hükümlerintamamına ilişkin olup mevcut İBK’daki 183 olan madde sayısı 220’ye yükselmiştir. Tasarıda, borcun kaynaklarındanolmak üzere ikinci bölümde haksız fiiller düzenlenmiş olup bu kapsamda; genel olarak sorumluluk, temyiz kudretinihaiz olmayanların sorumluluğu, organizasyon sorumluluğu, tehlike sorumluluğu, hayvanlar tarafından yapılan zarardan sorumluluk, yapı malikinin sorumluluğu, devletin ve kamu çalışanlarının sorumluluğu ortaya konmuştur. Çalışmamızda kusursuz sorumluluk hallerine ilişkin olarak TBK’daki sistematik üzerinden mevcut İBK ve İBK 2020 tasarısındakidüzenlemeler karşılaştırılarak değerlendirmeler yapılacaktır.

The Swiss Code of Obligations has come into force in 1911, the draft prepared by Prof. Dr. Pierre Widmer and Prof. Dr.Pierre Wessner in order to be related to the law of liability could not become a law. The draft of SCO 2020 is relatedto all of the general provisions and the number of articles that is 183 in current SCO increased to 220. In the secondchapter of the draft, tortious acts were regulated to be the sources of the obligation. Within this scope, liabilityin general, liability of persons who do not possess the ability to discern, liability of organisation, danger liability,liability of the damage caused by animals, liability of the owner of the construction and liability of the governmentand the public servants is set forth. In our study, the evaluations related to the states of the strict liability will bedone by over the systematic in TCO, by comparing the regulations in the current SCO and the draft of the SCO 2020.
