İSTİNAF BAŞVURUSUNUN ESASTAN REDDİ KARARININ İCRANIN GERİ BIRAKILMASI İÇİN GÖSTERİLEN TEMİNATA ETKİSİ

Abstract

Hukukumuzda bir mahkeme kararının icra edilebilmesi için kural olarak kesinleşmesine gerek bulunmamaktadır. Ancak kesinleşmeden icra edilebilecek bir ilama bağlı olarak ilamlı icra takibi yapılması halinde, borçlu, kanunda öngörülmüş olan teminatı göstererek ve üst mahkemeden icranın geri bırakılması kararı alarak icra takibini durdurabilir. İlk derece mahkemesi kararına karşı istinaf yoluna başvurulan hallerde, borçlunun talebi üzerine bölge adliye mahkemesince teminat karşılığında icranın geri bırakılmasına karar verilmesi halinde, bu karar sadece istinaf incelemesi bakımından sonuç doğurur; etkilerini temyiz kanun yolunda da sürdüremez. Bölge adliye mahkemesince istinaf başvurusunun esastan reddine karar verilmesi halinde, teminat hemen alacaklıya ödenmemeli, borçlunun temyiz yoluna başvurması halinde temyiz incelemesinin sonuçlanması beklenmelidir. Bölge adiye mahkemesi kararına karşı temyiz yoluna başvuran borçlu, yine teminat karşılığında Yargıtay’dan icranın geri bırakılmasına karar verilmesini talep edebilir. Ancak bu durumda borçludan yeni (ikinci kez) bir teminat istenmemeli, borçlu istinafa başvururken gösterdiği aynı teminatı temyiz aşaması için de gösterebilmeli, ancak bu durumda gerekirse teminatın artırılması yoluna gidilmelidir. Ancak bu son belirtilen husus hakkında yasal bir düzenleme yapılması isabetli olacaktır.

In our law, it is not necessary for a court decision to be finalized for the decision to be enforced. However, in case of an enforcement proceeding with judgement due to a court decree which can be enforced without finalization, the debtor can cease the execution proceedings by providing the collateral stipulated by law and receiving a decision from the court regarding postponement of execution. In cases where a request for appeal is filed against the decision by a court of first degree and if the regional court of justice renders a verdict to postpone the execution in exchange for collateral, this verdict may only bear a consequence with regard to examination of appeal; it does not maintain its effects on the law of appeals. In case the regional court of justice dismisses the request of appeal with prejudice, the collateral should not be paid to the creditor immediately and if debtor applies for appeal, the result of the appeal examination should be waited. The debtor who requests of appeal against the decision of regional court of justice can also request from the Supreme Court to render a verdict for the postponement of execution in exchange for a collateral. However, in this case a new (for the second time) collateral should not be requested from debtor, the debtor should be able to provide the same collateral at the appeal phase but in this case, the amount of the collateral should be increased if necessary. However, a legislative arrangement should be made regarding the last issue.
