Ege Denizi Kıta Sahanlığı Uyuşmazlığı

Abstract

Türkiye ile Yunan Devleti ilişkilerinde ele alınması gereken sorunlardan hiç yadsınamayacak olan başlıklardan birisi de Ege Denizi'ndeki kıta sahanlığı meselesidir. İki ülkenin de özellikle bu soruna dair argümanlarının farklı olması münasebetiyle ortaya kompleks bir alan çıkmaktadır.Projektörlerin küresel meselelere yoğunlaşması, iki ülkenin farklı siyasi, sosyal ve hukuksal parametreleri zaman zaman meseleyi sümen altı etmiştir. Ancak konunun gündeme taşınması, birbirine çok yakın coğrafi sınırlara sahip ve ortak çıkarları söz konusu olan bahsi geçen ülkeler arasındaki gerginliklerin üst düzeye tırmandığı dönemlerin tarih arşivlerinden çok kısa sürede gün yüzüne çıkması ile eşdeğer bir çaba gerektirmektedir.Söz konusu çalışmada, her iki tarafı ilgilendiren, soruna ilham veren, öze dair Ege Denizi ve adaların jeolojik perspektifine, kıta sahanlığı kavramına, uluslararası adalet divanı kararlarına, küresel çabalara, hukuksal belgelere, tarafların hukuksal konumlarına, iddialara, çekincelere, savunmaların arka planlarına, gerek hukuksal gerek tarihsel bir gözlükle bakarak inceleme yapılacaktır.

Aegean Continental Shelf problem is among the one of the most disputed issues which can not be ignored in relations between Turkey and Greece. The fact that both countries have different arguments concerning the problem poses especially this situation to be a complicated and a disputed area. That the projectors concentrate on the global issues and the two countries' different social, political and juridicial parameters obscured the matter from time to time. However; bringing forward this matter from historical archives to light requires a further effort that is equal to a great tension which has taken place between the two countries that share neighbouring geographical borders as much as they share some sort of a common interest.This article investigates, from both historical and legal point of view; the issues of the geological perspective of the Aegean sea and The Islands that concerns the both sides and inspires the issue; concept of the Continental Shelf, verdicts of the International Court of Justice, global efforts, legal documents, legal posture of the sides, allegations, reservations and background of the defenses.
