| dc.description.abstract | Söz konusu çalışmanın amacı, Türk Medeni Hukukuna 4721 sayılı Türk Medeni Kanunu ile giren "aile konutu" kurumunu tüm yönleriyle incelemek ve uygulamada ortaya çıkan eksikliklerle ilgili çözüm üretmektir. Çalışmamız üç bölümden oluşmaktadır. Birinci bölümde aile konutu kavramı ayrıntılı olarak incelenmiştir. Aile konutunun tanımı yapılmış ve unsurları açıklanmıştır. Aile konutunun taşıması gereken niteliklerden bahsedilmiştir. Ayrıca aile konutu ile ilgili bazı özel durumlar inceleme konusu yapılmıştır. Ardından da aile konutu için hukuki koruma tüm yönleriyle açıklanmıştır. İkinci bölümde 4721 Sayılı Türk Medeni Kanunu'ndaki aile konutu düzenlemesi inceleme konusu yapılmıştır. Üçüncü bölümde ise aile konutu şerhi incelenmiştir. Aile konutu şerhinin nasıl verileceği ve bu şerhin etkisinin ne olacağı üzerinde ayrıntılı olarak durulmuştur. Özellikle şerhin iyiniyetle ayni hak kazanma bakımından etkisi çeşitli görüşlerin karşılaştırılması suretiyle değerlendirilmiştir. | dc.description.abstract | The aim of the study is to examine the matrimonial home institution, which is included in the Turkish Civil Law with the Turkish Civil Code No. 4721, in all its aspects and to find solutions to the gaps that arise in practice. Our study consists of three chapters. In the first chapter, the concept of matrimonaile home has been examined in detail, its definition and its elements have been explained as well. The qualities that the matrimonial home should bear have been addressed. Besides, some specific cases related to matrimonail home have been examined. Moreover, all aspects of the legal protection for the matrimonial home was explained. In the second chapter, the question of the matrimonial home regulation in the Turkish Civil Code No. 4721 has been addressed. In the last chapter, the annotation of the matrimonial home is examined. The procedure of giving the annotation of the matrimonial home and the effects of this annotation has been discussed in detail. Particularly, the effect of the annotation regarding the good faith beneficiary has been evaluated by comparing various opinions.
