Rekabetin korunmasına ilişkin anayasal düzenlemeler: yeni anayasada nasıl bir rekabet?

Abstract

Anayasalar, devlet ve onun temel organlarının kuruluşunu, işleyişini ve devlet karşısında vatandaşların temel hak ve özgürlüklerini düzenleyen metinlerdir. Bu işlevinin yanında, devletin ekonomik ve ticarî sisteminin temeli de anayasalar tarafından belirlenir. Ekonomik ve ticarî sistemin belirlenmesi, rekabet kavramının içeriğini de tespit anlamına gelmektedir. Zira rekabet kavramının kapsamı ve içeriği, ekonomik sistemlere göre farklılık arz etmektedir. Anayasa hükümleri, hiyerarşik açıdan en üst norm olduğundan, daha alt düzenlemelere şekil vermekte, onların sınırını belirlemektedir. Yeni bir anayasanın yapımı süreci sonucunda da anayasada yer alacak rekabete ilişkin hükümlerin, rekabet hukukunun ana ilkelerini belirleyeceği ve ona yön vereceği kuşkusuzdur. Bu bağlamda, yeni anayasada rekabet kavramına yer verilip verilmemesi gerektiği, yer verilecekse, içeriğinin nasıl belirleneceği önem taşımaktadır. Çalışmamızın asıl konusu da bu olacaktır. Çalışmamız, genel olarak şu sistematik çerçevesinde şekillenecektir: Öncelikle, eski anayasalarımızda ve hâlen yürürlükte bulunan 1982 Anayasasında yer alan rekabet hükümlerine değinilecek, daha sonra, 1982 Anayasasındaki 167/1 hükmü ayrıntılı olarak ele alınacaktır. Son olarak ise yeni anayasada rekabet kavramına yer verilip verilmemesi gerektiği tartışılıp, yer verilecekse buna ilişkin bazı önerilerde bulunulacaktır. Çalışmamız, varılan sonuçları içeren kısa bir sonuç kısmı ile noktalanacaktır.

Constitutions are the texts arranging the foundations of the state and its basic organs and the basic rights and freedoms of the citizens against the state. Besides this function, the basis of the economical and commercial system of the state is determined by the Constitutions. The determination of the economical and commercial system also means the determination of the content of the competition concept. Thus the content and scope of the competition concept differs according to the economical systems. As the provisions of the Constitution are hierarchically the highest norm, it gives shape to the sub-regulations and it determines their limits. During the establishment of the New Constitution, the provisions to be included in the constitution concerning the competition shall certainly determine the main principles of the competition law and shall direct these. Within this context, it is determined whether competition concept takes place in the new constitution or not and it is also important to determine the content of the competition if it takes place in the new constitution. The main subject of our study shall be this. Our study shall be formed within the framework of this systematic: first of all, the competition provisions within the 1982 Constitution still in force shall be taken into consideration, and then the article No 167/1 within 1982 Constitution shall be considered in details. Lastly whether to include competition concept in the new constitution or not shall be discussed and if it shall be included, some suggestions shall be made concerning this issue. Our study shall be completed with a short result including the obtained results.
