Türkiye'de seçimlerin yönetimi ve denetimi

Abstract

Çalışmamızda, Anayasanın 79. maddesiyle seçimlerin yönetimi ve denetimi görevinin yargı organlarına verilmesinden hareketle, ülkemizde seçimlerin yönetimi ve denetimi faaliyetinin seçim kurulları tarafından nasıl gerçekleştirildiği inceleme konusu yapılmıştır. Türkiye'de Seçimlerin Yönetimi ve Denetimi, üç ayrı bölüm halinde ele alınmıştır. Birinci bölümde, seçim hukukuyla yakından ilgili kavram ve ilkelerden bahsedilmiş; ardından seçimlerin yönetimi ve denetimine ilişkin modeller, bazı Avrupa ülkelerinden örneklerle açıklanmıştır. Devamında, seçim yargısının Osmanlı Devleti'nden günümüze gelişim süreci, Yüksek Seçim Kurulunun kurulması ve hukuki niteliği ile ilgili karar ve görüşler incelenmiş; Türk hukukunda seçim teşkilatının yapısı, seçim kurullarının yetki ve görevleri, ilgili mevzuat hükümleri çerçevesinde işlenmiştir. İkinci bölüm, ülkemizde seçimlerin yönetiminin aşamalarına ve bu süreçte seçim kurullarının üstlendikleri role ayrılmıştır. Son bölümde ise, seçimlerin denetiminin hangi kurallar çerçevesinde hangi organlar tarafından yürütüldüğü açıklanmış; Yüksek Seçim Kurulunun seçimlerin denetimi konusunda vermiş olduğu önemli kararlar, hukuki çerçevede incelenmiştir. In our study, with the article 79 of the Constitution, based on the assignment of the management and control of elections to the judicial bodies, the subject of examination of how the management and control of the elections is carried out by the election boards in our country has been examined. Management and Supervision of Elections in Turkey are discussed in three separate sections. In the first part, the concepts and principles closely related to electoral law are mentioned; then models for the management and control of elections are explained with examples from some European countries. Subsequently, the decisions and opinions regarding the development process of the electoral judgment from the Ottoman State to the present day, the establishment of the Supreme Election Council and its legal nature were examined; In Turkish law, the structure of the electoral organization, the powers and duties of the election boards have been processed within the framework of the relevant legislative provisions. The second part is devoted to the stages of election management in our country and the role of election boards in this process. In the last part, it is explained by which organs under which rules the audits of elections are carried out; The important decisions made by the Supreme Election Council regarding the auditing of elections were examined within the legal framework.
