İslam hukuku ve osmanlı hukukunda vakıf müessesesi

Abstract

İslam hukuku ve Osmanlı hukukunda vakıf müessesesi adlı çalışmamızın temel amacı, İslam hukuku ve Osmanlı uygulamasında vakıf kavramının, vakfın menşeine ilişkin iddiaların, vakfın hukuki niteliğinin ve vakıfların tarih boyunca yürüttüğü hizmetlerin incelenmesidir. Bir hayır müessesesi olan vakıflar, İslâmiyet'in öğütlediği sadaka kavramı ile gelişmiş kurumlardır. Sosyal, kültürel, ekonomik pek çok alanda hizmet veren ve fıkıh hükümlerinin şekillendirdiği bu kurumlar, Osmanlı uygulamasında en üst mertebeye erişmiştir. Çalışmamız iki bölümden oluşmaktadır. Birinci bölümde ilk olarak vakıf kavramı, vakfın menşeine ilişkin görüşler, vakfın İslamiyet öncesinde ve sonrasında gelişimi ele alınmıştır. Vakfın kurulması, buna ilişkin şartların ve sonuçların da değerlendirildiği birinci bölümde, vakıfların idaresi ele alınmış, tevliyet kavramı incelenmiştir. İkinci bölümde ise vakıf çeşitleri menkul-gayrimenkul olarak değerlendirilmelerinin yanı sıra mülkiyet, mahiyet, idare, kiraya verilmesi ve yararlananlar bakımından ele alınmıştır. Son olarak vakıfların sunduğu hizmetler ve vakıf görevlileri konusuna temas edilmiştir. Anahtar Sözcükler: Vakıf, Sadaka, Hayır, Osmanlı Hukuku, İslam Hukuku.

The main objective of our study on "Foundations in Islamic Law and Ottoman Law" is to analyse the concept, the claims about the origin and the legal nature of the foundations and the services will provided by the foundations in Islamic and Ottoman law. Foundations are charitable institutions and they developed by the concept of charity in Islam. These foundations were gave service in lots of areas such as social, cultural, economic and they were shaped by Islamıc law. Also foundations reached its peak in the Ottoman law. Our study is composed of two chapter. The concept of foundations, views about their origins and the development of them before and after Islam were handled in the first part. The establishment of the foundations, their conditions and results related to the establishment were also determined in the first part. Also the administration of foundations, their conditions and results were evaluated; the concept of custody were investigated. In the second chapter, types of foundations were estimated just as movable-unmovable property and they were analysed about their composition, administration, beneficiary.
