Türk Ceza Hukuku açısından mobbing

Abstract

Tez çalışması işyerinde gerçekleşen, çalışanlar üzerinde belli bir süre devam eden, yıldıran, işyerinden uzaklaştıran, işverimini düşüren ve birçok olumsuz etkiler yaratan davranışlar silsilesinden oluşan mobbingi Türk Ceza Hukuku açısından konu edinmektedir. Tez giriş ve sonuç dışında üç ana bölümden oluşmaktadır. Birinci bölümde mobbing kavramı, tanımı, tarihi gelişimi süreci ve mağdur üzerindeki etkileri incelenmiştir. İkinci bölümde mobbing kavramı; unsurları ile beraber Türk Ceza Kanununda mobbinge vücut veren suç tipleri ile kıyaslanarak ele alınmıştır. Üçüncü ve son bölümde ise uluslararası metinlerde ve karşılaştırmalı hukukta mobbing ve mobbingin ayrı bir suç tipi olarak Türk Ceza Kanununda düzenlenmesi sorunu kendi görüşlerimizle birlikte incelenmiştir.

Thesis study has been focused on comprising the mobbing in the Turkish Criminal Law terms that occurs in the working place, continuing a certain time on the employees, intimidates, gets suspended from work, lowers the work performance and consisted of lineage of behaviors which create many negative effects Thesis consists of three main parts, except the introduction and conclusion. In the first section mobbing concept,definition, historical development process and its effects on the victim has been studied. In the second section the main type of crime that of mobbing in the Turkish Criminal Law with together mobbing concept elements are discussed. In the third and final section mobbing the international and comparative law texts and dispute of approaching mobbing as a separate type of crime in the Turkish Criminal Law are discussed together with our own opinions.
