Türk Anayasal düzeninde sendika kurma hakkı

Abstract

Türk anayasal düzeninde sendika kurma hakkı 1982 Anayasasının 51 inci maddesinde düzenlemiştir. Buna göre; Çalışanlar ve işverenler, üyelerinin çalışma ilişkilerinde, ekonomik ve sosyal hak ve menfaatlerini korumak ve geliştirmek için önceden izin almaksızın sendikalar ve üst kuruluşlar kurma, bunlara serbestçe üye olma ve üyelikten serbestçe çekilme haklarına sahiptir. Hiç kimse bir sendikaya üye olmaya ya da üyelikten ayrılmaya zorlanamaz. Sendika kurma hakkı ancak, milli güvenlik, kamu düzeni, suç işlenmesinin önlenmesi, genel sağlık ve genel ahlak ile başkalarının hak ve özgürlüklerinin korunması sebepleriyle ve kanunla sınırlanabilir. Sendika kurma hakkının kullanılmasında uygulanacak şekil, şart ve usuller kanunda gösterilir. Aynı zamanda ve aynı iş kolunda birden fazla sendikaya üye olunamaz. İşçi niteliği taşımayan kamu görevlilerinin bu alandaki haklarının kapsam, istisna ve şuurları gördükleri hizmetin niteliğine uygun olarak kanunla düzenlenir. Sendika ve üst kuruluşlarının tüzükleri, yönetim ve işleyişleri, Cumhuriyetin temel niteliklerine ve demokrasi esaslarına aykırı olamaz. Anayasanın sendika kurma hakkına ilişkin bu hükmünde anayasa, anayasal devlet, sosyal devlet, sosyal hak, sendika, millî güvenlik, kamu düzeni, suç işlenme sinin önlenmesi, genel sağlık, genel ahlâk, hak ve özgürlük, işçi, işveren, işkolu, Cumhuriyetin nitelikleri ve demokratik esasların bilinmesi ve açıklanması gerekmektedir. Çalışanların ve çalıştıranların (işverenlerin) ekonomik ve sosyal hak ve menfa atlerini korumak ve geliştirmek için, sendika kurabilme, kurulmuş olan sendikalara üye olabilme, sendikalardan ayrılabilme ve sendikal faaliyetlerde bulunabilme hak ve öz gürlükleri, temel insan hak ve özgürlüklerinden sayılmaktadır. Bu tezde Anayasanın ve sendikalara ilişkin kanunların güncel halleri ince lenmiş, bu çerçevede sendikal haklara değinilmiş ve gerekli araştırmalar yapılmıştır. Sendikanın güncel tanımına göre amaç birliği, kuruluşta serbestlik ve ihtiyarilik, bağımsızlık özel hukuk tüzel kişiline sahip olma ve Cumhuriyetin temel nitelikleri ile de mokratik esaslara uygunluk' tan oluşan beş unsuru ele alınmış Anayasamızın 51 inci maddesinde bulunan kavramlar ile sendikalaşmayı tehdit eden ve onu amacından uzaklaştıran taşeronlaşma ve siyasallaşma kavramları açıklanmaya çalışılmıştır.

In the Turkish constitutional system the right to organize labour unions is regularized in article 51 of Turkish Constitution by 1982. Article 51 (As amended on October 17, 2001) Employees and employers have the right to form labour unions employers' associations and higher organizations, without obtaining permission, and they also possess the right to become a member of a union and to freely withdraw from membership, in order to safeguard and develop their economic and social rights and the interests of their members in their labour relations. No one shall be forced to become a member of a union or to withdraw from membership. The right to form a union shall be solely be restricted by law and with the purposes of safeguarding national security and public order and to prevention of crime commitment, protection of public health and public morals and the rights and freedoms of others. The formalities, conditions and procedures to be applied in exercising the right to form union shall be prescribed by law. Membership in more than one labour union cannot be obtained at the same time and in the same work branch. The scope, exceptions and limits of the rights of civil servants who do not have a worker status are prescribed by law in line with the characteristics of their job. The regulations, administration and functioning of labour unions and their higher bodies should not be inconsistent with the fundamental characteristics of the Republic and principles of democracy. In this article which is related the right to or ganize labour union, Constitutional government, social government, social rights, union, national security, public order, to prevention of crime commitment, public health, public morals, rights and freedoms, employee, employer, the work force, the qualities of republic and the principles of democracy must be known and explained. In order to protect and progress of economical and social rights and interest of employees and employers, to form union associations, and they also possess the right to become a member of a union and to freely withdraw from membership, the right and freedom of union activities are respected as a principle of human right and freedom. nIn this thesis are examined the current forms of The Constitution and the laws which are related unions, in this frame is referred the rights of union and made required studies. The five elements of union are considered, the current meaning of union, as unity of goals, to form union without obtaining permission, to be voluntary, freedom, to have judicial personality of private law, basic principles of republic and compability to principles democracy. In the concepts of the article 51 of Constitution are worked to explain of effort, to become subcontractor and to become politic are threatened against to organize themselves into a labour union and taken them away from their goals. m
