Taksitle satış sözleşmelerinde tüketicinin korunması

Abstract

Tüketicinin korunması ülkemiz gündemine son zamanlarda giren hukuki açıdan en önemli sorunlardan biridir. Türk hukuk sisteminde bu konu ile alakalı yeni bir takım düzenlemeler yapılmaktadır. Bu düzenlemelerin en önemlilerinden birisi Tüketicinin Korunması Hakkında Kanun'dur. Bu Kanun'da, daha önceden düzenlenmiş ya da düzenlenmemiş baza önemli konulara yer verilmiştir. Taksitle satış sözleşmeleri de daha önceden Borçlar Kanunu ve Medeni Kanun'da düzenlenmiş ve Tüketicinin Korunması Hakkında Kanun ile hakkında yeni hükümler getirilmiş konulardan birisidir. Taksitle satışlarla alakalı bu düzenlemelerde bir takım yanlışlıkların olduğu görülmektedir. Bu durum ise tüketicilerin aleyhine bir durum ortaya çıkarmaktadır.Biz de bu tezde taksitle satışları eski ve yeni düzenlemelerin tamamım tüketicinin korunması açısından ele alarak inceledik ve bu yanlışlıkların düzeltilmesi ile alakalı çözüm önerileri ortaya koyduk.

The protection of consumer, which has put recently on the agenda of Turkey, is one of the most important problems from the aspect of jurisprudence. In the Tukish Law System, a few new regulations are held about thiz subject. One of the important regulations isthe Law of Protection of Consumer. İn this law, some of the newly or previously arranged considerable subjects are discussed. Installment sale contracts, arranged previously in the Law of Obligation and the Civil Law, is also one of the subjects which bears new rules via the Law of Protection of Consumer. Acertain number of mistades are observed in those regulations about the installment sales. This situation reveals disadvatages to the consumers. Inthis thesis, all of the past and new regulations about the installment sales are discussed from the aspect of the protection of consumer and solution proposals are exposad to amend those mistakes.
