Türk Ceza Muhakemesi Hukukunda soruşturma evresinin sona ermesi

Abstract

Bu tezin kapsamını, soruşturma evresinin sona ermesinin yolları oluşturmaktadır. 5271 numaralı Ceza Muhakemesi Kanununa göre, soruşturma evresinin, iki şekilde sona ermesi mümkündür: 1- Soruşturma evresinin, iddianamenin kabulü kararı ile sona ermesi (CMK m. 175/1). 2- Soruşturma evresinin, kovuşturmaya yer olmadığı kararı ile sona ermesi (CMK m. 172). Buna karşılık, tez içerisinde, soruşturma evresini sona erdiren yeni bir kararın kabul edilmesi gerektiği belirtilmiştir. Bu kararın adı, soruşturma işlemlerine son verilmesi kararıdır. Ayrıca tez içerisinde, bu kararlardan, kovuşturmaya yer olmadığı kararı, farklı bir adlandırmayla kullanılmıştır. Bu farklı adlandırma, iddianamenin düzenlenmesine yer olmadığı kararı şeklindedir.

The content of this dissertation is the way of the end of the investigation phase. According to Criminal Procedure Code No. 5271, it is possible that the investigation phase ends in two ways: 1- The end of the investigation phase with the decision of admission of indictment (CPC a. 175/1). 2- The end of the investigation phase with the decision of non-prosecution (CPC a. 172). On the contrary, in this dissertation, it is specified that a new decision, which is ending the investigation phase, must be accepted. The name of this decision is the decision of ending the investigation procedures. Additionaly, in the dissertation, from these decisions, the decision of non-prosecution is used with a different naming. This different naming is the decision of non-drafting of indictment.
