Türk siyasal hayatında Abdullah Gül'ün Türkiye Cumhuriyeti'nin 11. cumhurbaşkanı olarak seçilmesi

Abstract

Türkiye Cumhuriyeti'nde Cumhurbaşkanlığı makamı özel bir öneme sahiptir. Bu durum hem ülkemizin tarihsel geçmişiyle hem de Anayasalar ile Cumhurbaşkanına verilen yetkilerin klasik parlamenter sistemin boyutunu aşmasıyla ilgilidir. Bu yüzden Cumhurbaşkanlığı seçim süreçleri de ülkemizde gündemi oldukça meşgul eden konular arasında yer almaktadır. Bu tezde, Türkiye Büyük Millet Meclisi tarafından seçilen son Cumhurbaşkanı olan Abdullah Gül'ün seçim sürecinde yaşanan siyasi ve hukuki gelişmeler ele alınmıştır. 11. Cumhurbaşkanlığı seçim sürecinde yaşanan olaylar ve tartışma konuları daha önceki seçimlerden farklı olması bakımından ve Cumhurbaşkanının seçim usulünün değişmesine varan sonuçları itibariyle oldukça önemlidir. 11. Cumhurbaşkanlığı seçim sürecinde, seçimin kilitlenmesine sebep olan, ciddi bir siyasal ve hukuki kriz yaşanmıştır. Bu çalışmanın amacı Abdullah Gül'ün Cumhurbaşkanı olarak seçilmesine kadar olan süreçte yaşanan gelişmelerin nedenlerini ve sonuçlarını ayrıntılı olarak incelemektir. Anayasa Mahkemesi'nin de dahil olduğu bu kriz ortamının aşılması için genel seçimler erkene alınmış ve böyle bir krizin tekrar yaşanmaması için Anayasa değişikliği yoluna gidilmiştir. 5678 sayılı Kanun ile gerçekleştirilen ve Cumhurbaşkanının halk tarafından seçilmesi usulünü benimseyen Anayasa değişiklikleri siyasi tarihimizde oldukça önemli bir konuma sahiptir. Bu değişiklikler ile 11. Cumhurbaşkanının da halk tarafından seçilmesi öngörülmüş ancak Abdullah Gül Meclis tarafından değişiklik öncesi anayasal kurallar çerçevesinde seçilen son Cumhurbaşkanımız olmuştur.

The Presidency has a special importance in the Republic of Turkey. This situation is related to both the historical background of our country and the fact that the powers given to the President by the constitutions exceed the size of the classical parliamentary system. Therefore, the presidential election processes are among the issues that occupy the agenda in our country. In this thesis, the political and legal developments in the election process of Abdullah Gül, the last President elected by the Turkish Grand National Assembly, are discussed. The events and discussion topics in the 11th presidential election process are very important in terms of being different from the previous elections and the consequences of changing the election procedure of the President. During the 11th presidential election process, there was a serious political and legal crisis that caused the election to be locked. The aim of this study is to examine in detail the reasons and results of the developments in the process until Abdullah Gül's election as President. In order to overcome this crisis environment, including the Constitutional Court, the general elections were postponed and a constitutional amendment was made to prevent such a crisis from happening again. Amendments to the Constitution, which were made by Law No. 5678 and adopted the method of election of the President by the people, have a very important place in our political history. With these amendments, the 11th President was also foreseen to be elected by the people, but Abdullah Gül was the last President to be elected by the Assembly within the framework of the constitutional rules before the amendment.
