İbn Kayyım el-Cevziyye'nin İ'lamü'l Muvakkıîn eserinde makâsıda dair görüşleri

Abstract

Allah Teâla'nın yeryüzünde adaleti tahsis etmek için gönderdiği İslâm'ın hiçbir kuralı gereksiz değildir. İslâm'ın tüm kurallarında ya bir maslahatın celbi ya da bir mefsedetin def'i vardır. Alimler bunu daha teknik bir ifade olan makâsıdü'ş-şerîa olarak isimlendirmişlerdir. İbn Kayyim el-Cevziyye'nin İ'lâmü'l-Muvakkıîn isimli kitabı bir İslâm hukuk metodolojisi eseri mahiyetindedir. Bu metodolojinin Hz. Peygamber'den itibaren gelişim seyri ve genel esasları eserde ele alınmıştır. Kitapta usûl konuları detaylı bir şekilde incelenmiş, ardından konular delillerle izah edilmiştir. Bundan dolayı kitap, temel usûl eserleri içerisinde kabul edilmektedir. İbn Kayyim el-Cevziyye'nin İ'lâmü'l-Muvakkıîn isimli eserinde İslâm hukukunda yer alan maslahata dair hükümlerin tespiti önem arzetmektedir. Bu çalışmada İ'lâmü'l-Muvakkıîn eseri içerisindeki maslahat ve makâsıd temelli hükümler tespit edilmiştir.

None of the rules of Islam, which Allah has sent to allocate justice on earth, are superfluous. In all the rules of the Islam, there is either summon to a benefit or elimination of a depravement. Scholars have named it makâsıd'üş-şerîa, which is a more technical expression. Ibn Qayyim al-Cevziyye's book titled İ'lâmü'l-Muvakkıîn is a work of Islamic legal methodology. The general principles and the course of development of this methodology since the Prophet are discussed in the work. In the book, procedural issues are examined in detail, and then the issues are explained with evidence. Therefore, the book is accepted as one of the main procedural works. In Ibn Qayyim al-Cevziyye's book titled İ'lâmü'l-Muvakkıîn, it is important to determine the provisions regarding the interest in Islamic law. In this study, maslahat and maqasid-based provisions in the work of İ'lâmü'l-Muvakkıîn were determined was made.
