Sulh Sözleşmesinin Konusunun Sınırları

Abstract

Sulh sözleşmesi, tarafların aralarındaki mevcut bir hukuki ilişki üzerindeki uyuşmazlığı ya da belirsizliği ortadankaldırmak amacıyla, birbirlerine karşılıklı fedakarlıkta bulunmak suretiyle yaptıkları bir sözleşmedir. Sulh sözleşmesi,taraflar arasında mahkeme dışında yapılırsa mahkeme dışı sulh sözleşmesi olarak, mahkeme huzurunda ve hakiminkatılımıyla gerçekleştirilirse mahkeme içi sulh sözleşmesi olarak adlandırılır. Davayı sona erdiren taraf işlemlerindenolan mahkeme içi sulh sözleşmesi bu çalışmanın konusu dışında kalmaktadır. Uyuşmazlıkların giderilmesinde tarafiradelerinin ön planda olması sebebiyle, sulh sözleşmesi taraflar arası ve toplumsal barışa katkı sağlamak gibi çokönemli fonksiyonlara sahiptir. Bu sebeple, bu çalışmada sulh sözleşmesinin konusunun sınırları ele alınmıştır.

Compromise contract, is an agreement made with compromises by each party to eliminate the dispute or uncertaintyover an existing legal relation between them. If a compromise contract is made between parties outside of the court,it will be named extrajudicial compromise contract, and if made in the court with the participation of a judge, it will benamed intra-court compromise contract. Intra-court compromise contract, one of the party procedures ending thecase, is outside of this scope. As the will of the parties is forefront in the settlement of disputes, compromise contracthas significant functions such as contributing to inter-party, and hence to social peace. For this reason, in this studythe limits of the compromise subject have been addressed.
