YÖNETİMDE İSTİKRAR İLKESİNİN GERÇEKLEŞMESİNE YÖNELİK BİR ARAÇ OLARAK SEÇİM BARAJI UYGULAMALARI

Abstract

Yürütmenin, parlamentodaki çoğunluğa dayalı olarak oluştuğu ve görevini sürdürdüğü parlamenter hükümet sistemlerinde seçim sistemlerinden de istikrarlı bir hükümet sonucunu doğurması beklenir. İstikrarlı bir hükümet etkin iki partili bir parlamento yapısına yol açan çoğunluk sistemlerinin tercih edilmesiyle ulaşılabileceği gibi nispi temsil sistemlerinde ise aynı sonuca seçim barajı uygulamaları ile ulaşılabilir. Türkiye'de 16 Nisan 2017 tarihli halkoylamasıyla kabul edilen Anayasa değişikliğinin hükümet sistemine ilişkin hükümleri istikrarlı bir yönetimin gerçekleşmesini sağlamaya yöneliktir. Söz konusu durum Türkiye'de uygulanan seçim sistemleri ve baraj uygulaması konusunu tekrar gündeme getirmiştir.

It is expected that the election systems produce a stable government result in parliamentary government systems in which the executive occurs and carries out its duty based on the majority in parliament. As a stable government can be achieved by preference of the majority system leading to a bipartisan parliamentary structure, the same result can be achieved with election threshold implementations in the relative representation systems. The provisions of the Constitutional amendment adopted in the referendum of 16th April 2017 in Turkey regarding the government system are aimed at ensuring that a stable governance takes place. This situation has reawakened the issue of election systems and threshold implementation in Turkey.
