Abstract

Arabuluculuk Sözleşmesi isimli çalışmamızda, Hukuk Uyuşmazlıklarında Arabuluculuk Kanunu'nun yürürlüğe girmesi ile birlikte, Ülkemizde de uygulanmaya başlayan ve ihtiyaçlar ekseninde her geçen gün geliştirilmekte olan arabuluculuk yöntemine ilişkin uyuşmazlığın taraflarınca akdedilen arabuluculuk sözleşmesi, tüm detayları ile ele alınacakt ır. Bu çalışmamız ile arabuluculuk yöntemine yönelik uygulamada karşılaşılan sorunların çözümünde yol gösterici olmak ve özellikle arabuluculuk sözleşmesinin uygulanabilirliğini artırmak suretiyle, arabuluculuk kurumunun toplumda daha fazla karşılık bulmasını ve etkin kullanılmasını teşvik etmek amaçlanmıştır. Çalışmamızda literatürdeki kaynaklar içerik analizi metoduyla incelenerek, öncelikli olarak arabuluculuk yöntemi genel itibariyle ele alınmıştır. Bu kapsamda çalışmamızın ilk bölümünde, arabuluculuk kavramı, özellikleri, tarihsel gelişimi, türleri, yönteme hâkim olan temel ilkeler, yöntemin devlet yargısına nazaran avantajları ile aksayan yönleri ve arabuluculuk sürecinin aşamaları üzerinde durulmuştur. Çalışmamızın devamında, ilk etapta sözleşme kavramı, unsurları, türleri ve özellikleri kısaca ele alınmışt ır. Daha sonra arabuluculuk sözleşmesi tüm detaylar ı ile incelenmeye başlanmışt ır. Öncelikle arabuluculuk sözleşmesinin tanımı, unsurları, hukuki niteliği, içeriği, kuruluş aşamaları ve süreci irdelenmişt ir. Akabinde sözleşmenin taraflar için bağlayıcı olup olmadığı, zamanaşımı ve hak düşürücü sürelere etkisi ele alındıktan sonra sözleşme benzer kurumlarla karşılaşt ırılmışt ır . In our "Mediation Agreement" named study, the mediation agreement will be discussed in detail that agreed by the parties of the conflict related to mediation contract which is starting to find application areas for itself in our country and being developed day by day in the centerline of needs with becoming effective of the Mediation Law in Legal Conflicts. By our study, it is aimed to be a guide for the solutions for the problems being encountered in the application related to the mediation method and correspond the mediation institution more in the society and encouraging to use it more effectively, especially by enhancing the applicability of the mediation agreement. In our study, the mediation method was primarily discussed in general terms by examining the sources in the literature with content analysis method. In this scope, in the first chapter of our study, it was focused on that the concept of mediation, it's specifications, historical development, types, fundamental principles which predominate the method, advantages of its method compared to government jurisdiction with its aspects of setback and the stages of the process of mediation. Afterwards in our study, at the first step it was briefly discussed the concept of agreement, its elements, types and specifications. Later on, the mediation agreement was examined with all its details. First, the definition of mediation agreement, its elements, legal characteristic, content, founding purposes and process were studied. Soon after that the agreement was compared with the similar institutions, after discussing the agreement if it contains binding for the parties, its effect to prescription and foreclosures.
