Türk hukukunda spor federasyonlarının hukuki statüsü

Abstract

Türk Hukukunda spor federasyonlarının sahip olduğu tüzel kişiliğin niteliği hakkında yasal mevzuatta herhangi bir nitelendirilmeye yer verilmemiş olması; öğretide farklı görüşlerin ortaya çıkmasına, yargıda ise farklı tarihlerde birbiriyle çelişen kararlar verilmesine neden olmaktadır. Bu nedenlerden ötürü spor federasyonlarının tüzel kişi niteliğinin açık bir şekilde belirlenmesi gerekmektedir. Ülkemizde futbol dışında kalan diğer amatör spor dallarında faaliyet gösteren bağımsız spor federasyonları, 3289 sayılı Gençlik ve Spor Hizmetleri Kanunu ile düzenlenmiştir. İlgili yasada bağımsız spor federasyonlarının Cumhurbaşkanlığı kararnamesi ile kurulacağı ardından ilgili kararın Resmi Gazete'de yayımlanarak tüzel kişilik kazanacağı düzenlemesine yer verilmiş, ancak bu tüzel kişiliğin niteliği açık bir şekilde ortaya konulmamıştır. Diğer taraftan, Türkiye Futbol Federasyonu ise 5894 sayılı Türkiye Futbol Federasyonu Kuruluş ve Görevleri Hakkında Kanun ile düzenlenmiştir. Bu yasada, futbol federasyonunun özerk, tüzel kişiliğe sahip ve özel hukuka tabi olduğu belirtilmiş, ancak yasa koyucu bağımsız spor federasyonlarında olduğu gibi, futbol federasyonunun sahip olduğu tüzel kişiliğin niteliğine ilişkin bir değerlendirmede bulunmamıştır. İlgili yasa metinlerini incelediğimizde, hem bağımsız spor federasyonlarının hem de Türkiye Futbol Federasyonunun, kamu hukuku kapsamına giren bazı imtiyaz ve yetkilere sahip oldukları; ancak bunun yanında özel hukuk kapsamına giren bazı özelliklere de bünyelerinde yer verildiğini görmekteyiz. Çalışmamız içerisinde spor federasyonlarının sahip oldukları tüzel kişiliğin hukuki niteliği; konuya ilişkin öğretide yer alan görüşler, yargı kararları ve ilgili yasada yer alan hükümleri, özel hukuk tüzel kişileri ve kamu tüzel kişilerinin özellikleri ile karşılaştırmak suretiyle belirlenmiştir. Bağımsız spor federasyonlarının kamu tüzel kişiliğine sahip ve hizmet yönünden yerinden yönetim kuruluşları arasında yer aldığını, diğer taraftan Türkiye Futbol Federasyonu'nun ise kendine özgü (sui generis) bir tüzel kişiliğe sahip olduğu kanaatindeyiz. The absence of any qualification in the legal legislation on the quality of the legal entity owned by sports federations in Turkish Law; it leads to the emergence of different views in the doctrine and conflicting decisions at different dates in the judiciary. For these reasons, the nature of the legal entity of sports federations needs to be clearly defined. Independent sports federations operating in other amateur sports branches other than football in our country are regulated by the Law No. 3289 on Youth and Sports Services. The related law stipulates that independent sports federations will be established with the Presidential decree, and then the related decision will be published in the Official Gazette, but the nature of this legal entity is not clearly defined. On the other hand, if Turkey Football Federation No. 5894 Turkey Football Federation is regulated by the Law on the Establishment and Duties. This law states that the football federation is autonomous, legal and subject to private law, but the legislator does not make an assessment of the nature of the legal entity owned by the football federation, as in the independent sports federations. When we examine the relevant legal texts, both the independent sports federations of Turkey Football Federation, they have some privileges and powers within the scope of public law; however, we also see that some of the features that fall under the scope of private law are included. In our study, the legal nature of the legal entity owned by sports federations; The opinions in the doctrine of the subject are determined by comparing the provisions of the judicial decisions and the provisions of the relevant law with the characteristics of private legal entities and public legal entities. Individual sports federations had taken place between government institutions and services to the displaced direction with public entities, on the other hand, Turkey's Football Federation is unique (sui generis) We believe that it has a legal personality.
