İdare Hukuku bağlamında E-Devlet dönüşümü ve UYAP

Abstract

Dijitalleşen dünyada idare teşkilatının bundan etkilenmemesi mümkün değildir. Her dönemde toplumların teknik özellikleri, idarenin yapısına sirayet etmiştir. Bilgi toplumunun içerisinde bulunduğumuz bugünlerde, internet ve bilgisayar kamu işlerinde artarak kulanılmamaktadır. Bugün kamu hizmetlerinin sunumunda bilişim sistemlerinin kullanımı sonucu yaşanan gelişmelere paralel olarak birçok farklı ülkede elektronik devlet projeleri de tasarlanmıştır. Dünyada bu projeler neticesinde kamu hizmetleri elektronik ortama aktarılmıştır. Ülkemizde de e-devlet dönüşümü çalışmaları sonucunda birçok kamu hizmeti elektronik ortamda sunulmaya başlanmıştır. Bu yeni durum hukuk sistemimizde değişime neden olmuştur. E-dönüşüm, vatandaşların her gün karşı karşıya geldiği idarenin işlemlerini, yapısını ve işleyişini etkilemiştir. İdari işlemlerin temel unsurlarında değişimler meydana gelmiştir. E-imza kullanımının yaygınlaşması, e-idarenin gelişimine katkı sunmuştur. Elektronik ortamda yapılan işlemlerde güvenliğin sağlanmasında e-imza çok önemli bir unsurdur. 5070 sayılı yasal düzenleme ile ülkemizde e-imzanın kullanımına dair çerçeve belirlenmiştir. İdari alanda yapılan e-işlemlere ilişkin e-imza alanında hususi düzenlemelerin yapılması beklenmektedir. Çalışmamızın diğer bir yönünde, e-devlet dönüşümünün adalet hizmetlerinin sunumuna yansıması olan Ulusal Yargı Ağı Projesi (UYAP) Bilişim Sistemi, UYAP çalışmalarının tarihsel seyri ve yargılama sistemimize katkıları ele alınmıştır. Ayrıca, bu bilişim sisteminin kullanımının İdari Yargılama alanına katkıları ve sistemdeki yeniliklerin adil yargılanma hakkına katkıları incelenmiştir. Çalışmamızı oluştururken konular hakkında detaylı incelemeler, araştırmalar yapılmış, elde edilen veriler idare hukunun sınırları çerçevesinde aktarılmaya gayret edilmiştir. E-devlet hizmetleri sunan gelişmiş kurumların yöneticileri ile görüşülmüş, e-idari işlem tesis eden kuruluşların uzmanları ile mülakatlar yapılmış, pratikteki işleyiş yerinde gözlemlenmiştir. İdare teşkilatında e-dönüşümle meydana gelen değişimin mevzuatımızda yeterince yer almadığı görülmüştür. Uygulamada yürüyen elektronik süreçlerin mevzuatta da altyapısının oluşturulması gerektiği vurgulanmıştır. Her bölümde değerlendirdiğimiz konulara ilişkin ülkemizin faydasına olacak öneriler oluşturulmuştur.

In the digitalized world, it is impossible for the organization of the administration not to be influenced accordingly. In every period, the technical characteristics of the societies have spread into the structure of the administration. In these days when we are in the information society, internet and computers are increasingly used in public works. Today, parallel to the developments in the use of information systems in the provision of public services, electronic government projects have been designed in many different countries. As a result of these projects around the world, public services have been transferred to the electronic environment. Also as a result of e-government transformation in our country, many public services have been offered in electronic environment. This new situation has caused critical changes to our legal system. E-transformation has affected the structure and operation of the administrative transactions that the citizens deal with every day. Changes have occurred in the basic elements of the administrative process. The widespread use of e-signature contributed to the development of e-administration. In electronic environment, e-signature is a very important element in terms of providing security. With the legal regulation numbered 5070, the framework for the use of e-signature has been determined in our country. In the administrative field, it is stated that e-transaction and e-signature related arrangements are expected to be made. The National Judiciary Network (UYAP), which is the reflection of e-government transformation on the presentation of judicial services, has formed another aspect of our study. The historical progress of UYAP studies and its contribution to our judicial system are discussed in this research. Additionally, the reflections of the use of the informatic systems to the field of Administrative Procedure are presented. Also, the contributions of UYAP to the right to a fair trial are researched. While generating our study, detailed investigations and researches have been made and the data obtained have been tried to be transferred within the limits of the administration law. For the presentation of e-government services, the managers of the developed institutions; and the experts of the organizations that establish e-administrative operations have been interviewed; accordingly, the operation in practice has been observed on site. It is also seen that the change in e-transformation in the administrative organization is not sufficiently involved in our legislation. It is emphasized that the infrastructure of electronic processes to be operated in practiced should be generated also in the legislation. Suggestions that we think will be beneficial for our country are established in each section of our study.
