Konkordatonun 4734 Sayılı Kamu İhale Kanunu Kapsamındaki İhalelere Etkisi

Abstract

Bilindiği üzere şirketler açısından daha önce önemli bir uygulama bulan iflasın ertelenmesi müessesi 2018 yılında kaldırılmış ve 2004 sayılı İcra ve İflas Kanunu’nun 285 ve devamı maddelerinde düzenlenen konkordato, 28.02.2018 tarih ve 7001 sayılı Kanunla yeniden işlerlik kazanmıştır. Baştan başa günün koşullarına göre düzenlenen konkordato hükümleri yürürlüğe girer girmez mahkemelere birçok başvuru yapılmaya başlamıştır. Ayrıca konkordato ile birlikte bazı sorular gündeme gelmeye başlamıştır. Bu soruların başında da konkordatonun 4734 sayılı Kamu İhale Kanunu kapsamındaki kamu ihalelerine ne tür bir etkide bulunacağıdır. Bu çalışma kapsamında 4734 sayılı Kamu İhale Kanunu ve 4735 sayılı Kamu İhale Sözleşmeleri Kanunu kapsamında konkordatonun kamu ihale sürecine ve kamu ihale sözleşmelerine etkisi incelenmiştir.

As it is well known, postponement of bankruptcy, which was an important practice for companies, has been abolished in 2018 and debt settlement, regulated under the Article 285 and following articles of the Enforcement and Bankruptcy Act no 2004, has become functional again on 28.02.2018 through the Act No 7001. As soon as the new debt settlement provisions came into force which was rearranged in accordance with the today’s conditions many applications have been made in the courts. However, some questions have also been raised. In particular how the debt settlement will effect the public procurement tenders within the scope of the Public Procurement Act no 4737. This study will be reviewing the effects of debt settlement on public procurement process and public procurement contracts covered by Public Procurement Act No 4734 and Public Procurement Contracts.
