TÜRK BORÇLAR KANUNU MD. 473/II KAPSAMINDA İŞ SAHİBİNİN İŞİN DEVAMINI ÜÇÜNCÜ KİŞİYE VERME HAKKI

Abstract

Türk Borçlar Kanunu’nun 470-486. maddeleri arasında düzenlenen eser sözleşmesi uygulama alanı oldukça geniş olan ve iş görme borcu doğuran rızai bir sözleşmedir. Bu çalışmada Türk Borçlar Kanunu md. 473’II’de düzenlenen, eserin yüklenicinin kusuruyla ayıplı ya da sözleşmeye aykırı olarak meydana getirileceğinin işin devamında açıkça görülmesi durumunda, İş sahibinin eserin onarımını isteme ya da işin devamını üçüncü kişiye bırakılabilme hakları üzerinde durulmuştur.) Bu bağlamda TBK. md. 473/II hükmünün niteliği incelenmiş ve bu hükmün uygulanabilme şartları ile hukuki sonuçları ortaya konulmuştur.

The Construction (Work) Contract stipulated in Articles 470 trough 486 of the Turkish Law of Obligations is a broad voluntary contract which gives way to obligations due to execution of any work. In this study in case it is clearly determined that the works are proven to be deficient due to the default of the contractor or executed contrary to the provisions of the contract during construction stage as stipulated in Article 473/II of the Law of Obligations, the cases for the repair of such works or execution of such works by third parties at the expense of the contractor as far as the conditions may allow, are defined. In this context the legal nature of Article 473/II in general terms is reviewed and the legal applicability and consequences are defined.
