Türk borçlar hukukunda evde hizmet sözleşmesi

Abstract

Uygulamada sıkça karşılaşmasına rağmen 818 sayılı Borçlar Kanunu'nda bulunmayan "Evde Hizmet Sözleşmesi" 6098 sayılı Türk Borçlar Kanunu'nda yer alarak Türk Hukukunda kendisine yer bulmuştur. Kaynak olarak İsviçre Borçlar Kanunu 351. ve 355. maddeleri arasında belirtilen evde hizmet sözleşmesi, Hizmet sözleşmelerinin spesifik bir tür olarak Türk Borçlar Kanunu'nda düzenlenmesinde yarar görülmüştür. Bu tez, günümüzde yaygınlaşan şehir hayatının yoğun çalışma düzeni, değişen aile yapısının ve doğan ekonomik ihtiyaçların bir sonucu olarak, niteliksel işgücüne ve niceliksel işe ihtiyaç duyan özellikle büyükşehirlerde görülen evde hizmet sözleşmelerinin tarihsel gelişimini, hukuki çerçevesinin çizilmesi, diğer hukuk disiplinleriyle olan ilişkisini belirlemek ve bu sözleşmeyi yapacak olan kişilerin haklarını sorumlulukları bakımından bir nebze de olsa yarar sağlamak amacıyla hazırlanmıştır. Tezimizde sözleşmenin tanımı, hukuki niteliği, unsurları, tarafları ve tarafların borçları, sözleşmenin sona ermesi ve vergisel boyutu gibi konulara değinilmiştir.

Previously not included in Code of Obligations No 818 yet widely practiced, "Home Service Contract" has been included in the Turkish Code of Obligations No. 6098. Referenced in Articles 351 and 355 of the Swiss Code of Obligations, Home Service Contract has been agreed to be a special type of service contract in the Turkish Code of Obligations. This thesis is prepared to determine the historical development and legal framework of the home service contract specifically in metropolitan cities, which requires qualitative labour and quantitative work as a result of changing family structures, economic needs and intensive work order of city life which is widespread today, and establish the contract's relationship with other disciplines of law as well as to provide benefits to the persons who will make the contract in terms of their responsibilities and rights. In our thesis, the definition of the contract, its legal nature, contents, stakeholders and their debts, termination of the contract and tax obligations are discussed.
