Gemilerin sicile tescili

Abstract

Gemiler, mahiyetleri itibariyle taşınır olsa da sahip oldukları büyük ekonomik değer sebebiyle kanun koyucu tarafından kayıt altında tutulmak istenmiştir. Bu nedenle gemi sicilleri ortaya çıkmıştır. Aynı şekilde geminin maddi ve hukuki durumu hakkında bilgi sahibi olunması, bu bilgilerin aleni hâle getirilmesi ile kişilerin menfaatlerinin korunabilmesi için gemi sicilinin varlığı bir zorunluluk teşkil etmektedir. Gemi sicilleri yalnızca gemi hakkında bilgi vermeyip gemi ile ilgili ve gemi üzerindeki işlemlerin de yapılmasına olanak sağlar. Bu çalışma kapsamında öncelikli olarak gemi sicillerinden bahsedilmiştir. Çalışmanın asıl amacı ise gemilerin Milli Gemi Sicili'ne ve Türk Uluslararası Gemi Sicili'ne tescili ile ilgili esasları incelemektir. Tescil kavramı, geniş anlamda kullanılmış olup bünyesinde tadil ve terkini barındırmaktadır. Bu bağlamda sicil işlemleri ve usulleri detaylı olarak ele alınmıştır. Nihayet, tescille birlikte oluşan sicil kayıtlarının etkileri, aleniliği ile sicile güven ilkesi ve tescilin sonuçları hem Milli Gemi Sicili hem Türk Uluslararası Gemi Sicili açısından değerlendirilmiştir.

Even though the ships are movable in terms of their nature, they were requested to be recorded by the legislator due to their great economic value. For this reason, ship registers have emerged. Likewise, the existence of a ship registry is a necessity to be informed about the material and legal situation of the ship, to make this information public and to protect the interests of individuals. Ship registries not only provide information about ships, but also enable transactions related to and on the ship. In this study, primarily ship registries were mentioned. The main purpose of the study is to examine the principles regarding the registration of ships in the National Ship Registry and Turkish International Ship Registry. The concept of registration has been used in a broad sense and includes its amendment and cancellation. In this context, registry procedures and procedures are discussed in detail. Finally, the effects of the registry records formed with the registration, their publicity, the principle of trust in the registry and the results of the registration both in terms of the National Ship Registry and the Turkish International Ship Registry were evaluated.
