    Responsibility Of The Administration Due To Covid-19 Measures And Evaluation Of The Epidemic Conditions Within The Scope Of Force Majeure

    The new type of coronavirus (Covid-19) has caused harm in various ways all over the world since its first appearance. The administrations have carried out many activities and implemented measures to prevent the virus-induced epidemic. The manifestation of this situation has also manifested itself in Turkey. However, it is seen that the measures taken are suitable to cause situations against some people. For this reason, the responsibility of the administration may come to the fore frequently in the future. Administrations are obliged to compensate the damages they cause during their activities in accordance with the principles of service fault and strict liability. While the fault of service arises as a result of the administration's unlawful act during its activity, the activity of the administration in strict liability is in accordance with the law, but a loss has arisen against some people. In such cases, where strict liability may come to the fore, the harm suffered by the person for the benefit of society should not be left solely on this person. Upon this requirement, the administration is held perfectly responsible for the damage. However, the existence of certain circumstances may affect the responsibility of the administration. The legality of the measures taken in the current epidemic environment and the responsibility of the administration as a result are controversial. Whether the epidemic conditions affect the responsibility on behalf of the administrations needs explanation.
