dc.description.abstractTürkiye’de milletvekili genel seçimleriyle alakalı anayasa ve kanunlardaki bazı kurallar, adaylar arasındaki rekabette dengesizlik yaratarak bir takım adaletsizliklere sebep olduğu gerekçesiyle tartışılmaktadır. Bu çalışmanın amacı, Türkiye’de milletvekili genel seçimlerinde, halk tarafından seçme ve seçilme hakları kullanılırken, kanaatlerin özgürce ortaya koyulabilmesini kısıtlayarak veya engelleyerek parti adayları ve bağımsız adaylar arasındaki rekabetin adilliğini bozan faktörleri incelemektir. Cumhurbaşkanlığı Hükümet Sistemi’nde yasama ve yürütme görevlerinin verileceği kişileri belirleyecek seçimlerin birbirinden bağımsız olduğu açıklanarak, Anayasa’daki ‘yönetimde istikrar’ ilkesinin milletvekili seçimlerinde gözetilmesine gerek kalmadığı belirtilerek, bu seçimlerde ‘temsilde adalet’ ilkesinin uygulanması için gereken her şeyin yapılması üzerinde durulacak ve sistemdeki bozuklukların nasıl giderilebileceğiyle ilgili öneriler sunulacaktır.
dc.description.abstractSome rules in Turkish constitution and laws about general elections are discussing because of causing some injustice by generating imbalance in competition between candidates in general election. The main aim of this study is researching factors which distrupt fairness of competition between party candidates and independent candidates by limiting or blocking expression of opinions while people are using rights to elect and become elected in general elections in Turkey. It is stated that in Presidential Government System, because of elections for parliament and government became unconnected, no need remained to consider the principle of ‘stability in administration’ in constitution no longer. Therefore, it is stated that to implement the principle of ‘justice in representation’ everything needed should be done. At the end of this study, various suggestions on how disorders of election system can be solved are presented.
