Özet
Makalede genel hatlarıyla bağımsız idari otoriteler incelenmiştir. İnceleme yaparken de bağımsız idari otoritelerin Amerika Birleşik Devletleri’ndeki (ABD) ve Avrupa’daki durumu da karşılaştırmalı olarak ele alınmaya çalışılmıştır. I. Kısımda bağımsız idari otoriteler, günlük hayatta her geçen gün varlıklarını daha da hissettiren bir olgu olarak, ortaya çıkış nedenleri, gelişimi, faaliyet alanları ve ortak özellikleri, regülasyon kavramı ile birlikte izah edilmeye çalışılmıştır. II. Kısımda, bağımsız idari otoritelerin hukuki statüleri, olumlu ve olumsuz yönleri ve bu yapılara getirilen eleştiriler üzerinde durulmuştur. III. Kısımda, yargısal, idari ve mali açıdan denetlenmesi konularına değinilmiştir. Buna ilave olarak, bir kısım bağımsız idari otoritelerin Türk idari yapısındaki yerine dair değerlendirmelere de zaman zaman yer verilmiştir.
Our paper presents an overall analysis of independent regulatory agencies. While doing this, we tried to investigate their status in the USA and Europe in terms of comparative law. In the first section, we consider that the independent regulatory agencies emerge as a fact which makes us aware of them more and more strongly in our daily lives day by day, and we tried to explain the reasons of their emergence, their development, fields of activity and common features, together with the concept of regulation. In the second section, we dealt with their legal statuses, their negative and positive aspects and criticism that they receive regarding their structures. In the third section, we dealt with the supervisory issues in judicial, administrative and financial terms. Additionally, we also occasionally referred to evaluations regarding the place of some independent regulatory agencies in Turkish administrative structure.
