| dc.description.abstract | Ticaret unvanı, tacirin ticari faaliyetlerini yürütürken kullandığı addır. Unvan, taciri diğer tacirlerden ayırt ettiğinden tacirin ticari kimliğidir. Ticaret unvanı, özel hukuktan doğan haklardan fikri mülkiyet hakları kapsamındadır ve üzerindeki hak gayri maddi malvarlığı hakkıdır. Unvan, ticari faaliyetlerin tacirle işlemde bulunan kişilerle güven içinde yürütülmesi için önemlidir. Bu kapsamda unvanın çekirdek ve ek kısımlarının oluşturulması Türk Ticaret Kanunu'nda (TTK) sıkı şekil şartlarına bağlanmıştır. Ayrıca tacirin işlemlerini ticaret unvanı altında yapması zorunluluğu getirilmiştir. Son yıllarda ticari faaliyetlerdeki gelişmeler, yoğun bir rekabet ortamı doğurmuştur. Bu rekabet ortamında unvanın, tacirin elde ettiği ticari itibardan haksız yere faydalanmak isteyen kişilere karşı korunması TTK'daki özel hükümlerle ve haksız rekabet hükümleriyle sağlanmaktadır. Ayrıca ticaret unvanındaki ayırt edici sözcüğün marka olarak kullanılması halinde 556 sayılı MarKHK hükümlerine de başvurulmaktadır. Uluslararası alanda ise Paris Sözleşmesi m. 8,9 ile koruma talep edebilmek mümkündür. Çalışmamız, yukarıdaki açıklamalar doğrultusunda unvanın oluşturulması, hukuki niteliği ve korunmasından meydana gelmektedir | en_US |
| dc.description.abstract | Trade name is the name of a tradesman used for trade activities. Because the name distinguish the tradesman from others, it is accepted as commercial identity. Trade name is in the scope of intellectual property rights resulted from private law and its right is an intangible property right. The name is important for people who has a trade relationship with tradesmen to perform trade activities safely. In this context, constitution of core and additional parts of the name is strictly defined by Turkish Commercial Code (TCC). Additionally obligation for tradesmen to perform their trade activities under a trade name is in effect. Developments in trade activities in recent years bring forth an intensely competitive environment. In this competitive environment, the protection of tradesmen from people who wants to exploit their commercial credit is provided by special provisions and unfair competition provisions of TCC. Moreover in the case of using distinguishing word which is in trade name as brand name, provisions of 556 numbered statutory decree are also used. In international level it is possible to demand protection with Paris Convention for the Protection of Industrial Property article 8,9. In line with explanations above, this study constitutes the forming of trade name, its legal characteristics, and its protection. | en_US |
