Özet
İş sözleşmesi, işçinin işverene bağımlı olarak iş görmeyi, işverenin de karşılığında ücret ödemeyi üstlendiği sözleşme olarak tanımlanmıştır. İş görme, bağımlılık ve ücret unsurlarından oluşan iş sözleşmesi güven ilişkisi temeline dayanmaktadır ve sürekli borç doğuran sözleşme niteliğindedir. İş sözleşmesinin sahip olduğu bu nitelikler sözleşme sona erdikten sonra da birtakım yükümlülüklerin devam etmesine olanak sağlamaktadır. Bu çalışmanın özünü iş sözleşmesi, sözleşmenin art etkisi ve işçinin sözleşme sonrası rekabet yasağı yükümlülüğü ile sır saklama yükümlülüğü oluşturacaktır. An employment contract is an agreement whereby one party (the employee) undertakes to perform work in subordination to the other party (the employer) who undertakes to pay him remuneration. The employment contract establishes the terms and conditions of the job in terms of transaction costs, dependency, salary, and benefits, among other things. This type of contract is based on the duty of mutual trust and confidence. These qualifications of the employment contract allow certain obligations to remain in force and binding upon both the parties even after the termination of the contract. The essence of this dissertation will be the employment contract, the following effects of the contract after termination, limitation on the employee's competitive activities after termination and limitation on the employee's use of confidential information after termination.
