Özet
Sivil İtaatsizlik: Dünyadan ve Türkiye'den Örnekler isimli bu çalışmanın amacı: Sivil itaatsizlik olgusunun teorik temellerini inceleyerek, dünyadan ve Türkiye'den örnek sivil itaatsizlik olayları üzerinden sivil itaatsizliğin teoride ve pratikte ne olup ne olmadığı üzerine analizler yapmaktır. Sivil itaatsizlik olayları özelliklerine bakıldığında, devletin sistemini değiştirmeye yönelmeyen fakat yalnızca haksızlığı ve adaletsizliği gidermeyi amaçlayan olaylar olduğu görülmektedir. Sivil itaatsizliğin önemli koşulları; ortak adalet duygusuna ve kamu vicdanına seslenmesi, yasaya aykırılık, şiddetsizlik, kamuya açıklık ve eylem sonucu cezai yaptırımı göze alma durumudur. Bu çalışmada 15 ülkeden sivil itaatsizlik örnekleri ele alınmıştır. Görülmüştür ki, her ülkede gelişen sivil itaatsizlik olayları, o ülkenin kendine has konjonktürü içerisinde gelişmektedir. 'Wall Street'i İşgal Et' eylemleri, Cumartesi annelerinin eylemleri, Bergama'da siyanürlü altın arama karşıtı eylemler, düşünce suçuna karşı eylemler, başörtüsü eylemleri ve Taksim Gezi Parkı olayları detaylı olarak incelenmiştir. Görülmüştür ki, Taksim Gezi Parkı eylemleri dışındaki tüm eylemler sivil itaatsizliğin şartlarını yerine getirmektedir.
The aim of this work, named, as Civil Disobedience: Examples from world and Turkey, is to make analyzes on what civil disobedience is in theory and in practice in the case of civil disobedience from the world and Turkey. When we look at the characteristics of civil disobedience, it is seen that civil disobedience events do not tend to change the system of the state, but aim to eliminate injustice and unjust implementations. Important conditions of civil disobedience; To have a common sense of justice and public conscience, to be against the law, to be non-violent, to be open and perceptible to the public, and to accept the criminal sanction after the action. In this study, examples of civil disobedience from 15 countries were discussed. It is evident that the incidents of civil disobedience in every country develop within the conjuncture of that country. The actions of the "Occupy Wall Street", the actions of the Saturday Mothers, the anti-Cyanidated Gold Search in Bergama, the actions against the crime of thought, the headscarf actions and Taksim Gezi Park protests have been examined in detail. It is seen that all actions fulfill the conditions of civil disobedience outside of the Taksim Gezi Park protests.
