dc.description.abstractBu makalede, deniz yoluyla yolcu taşıma sözleşmesinde sözleşmenin tarafları olan taşıyan ve yolcunun sorumlulukları incelenmiştir. İnceleme kapsamında, ilk önce, sözleşmenin tarafları ayrı ayrı ele alınarak sorumluluklarına değinilmiştir. Bu kapsamda, önemi gereği taşıyanın sorumluluğu, asıl ve fiili (alt) taşıyan ayrımı yapılarak incelenmiştir. Asıl ve fiili (alt) taşıyanın sorumluluğun türü, sözleşmeye dayanan ve sözleşme dışı (haksız fiil) sorumluluk olarak ikiye ayrılmıştır. Daha sonra, sorumluluğun koşulları incelenmiştir. En sonunda da, kusura dayalı ve kusursuz sorumluluk hususu ele alınmıştır.en_US
dc.description.abstractIn this article, the responsibilities of the crrier and the passenger who are the Parties to the cntract in the contract of carriage by sea. Within the scope of the review, firstly, the Parties to the Cnvention were dealt with separately and their rsponsibilities were discussed. In this context, the ronsibility of the carrier due to its importance has been examined by making the distinction between the real carrier and sub-carrier. The type of liability of the real carrier and the sub-carrier is divided into two types, contractual and non-contractual (tort) liability. Later, the conditions of liability were examined. In the end, the faulty rsponsibility and objective responsibility has been addressed.en_US
