| dc.description.abstract | Tezin amacı sosyal yaşantımızda sıkça uyguladığımız kendisine bazı sonuçlar bağlanan zilyetliğin korunması yollarının araştırılmasıdır. Zilyetlik hususu anlaşılması zor bir kavram olduğundan dolayı çalışmada öncelikle zilyetliğin tanımı, hukuki niteliği, türleri, kazanılması ve kaybedilmesine ilişkin açıklamalarda bulunulmuştur. Zilyetlik kavramının anlaşılması sağlandıktan sonra zilyetliğin korunması yollarının Osmanlı Hukuku ve Roma Hukukundaki uygulamalarından bahsedilmiştir. Bu sayede zilyetliğin korunması yollarının önceki dönemlerdeki uygulamaları da anlaşılarak mevcut zilyetliğin korunması yollarının daha doğru değerlendirilmesi yapılabilecektir. Hukuk sistemimizdeki mevcut zilyetliğin korunması yolları detaylı olarak ayrı ayrı ele alınmıştır. Zilyetliğin korunmasının öneminin anlaşılması, amacıyla zilyetliğin fonksiyonları incelenmiştir. Çalışmanın niteliği ve amacı itibariyle zilyetlik davaları ile bağlantılı olan ve uygulamada karıştırılma ihtimali bulunan taşınır davası ile istihkak davasının zilyetlik davaları ile karşılaştırılması yapılmakla yetinilmiş olup ayrıca bu davalar incelenmemiştir. Çalışma neticesinde sosyal yaşantı açısından büyük öneme sahip olan zilyetliğin korunma yolları detaylı olarak incelenmiştir. Bu çalışma neticesinde zilyetlik kavramının net olarak tanımının yapılamadığı, hukuki niteliği hususunda tartışmaların mevcut olduğu anlaşılmıştır. Kötüniyetli zilyedin malı kullanmasından dolayı bir bedel ödeyip ödemeyeceği, ödeyecek ise hangi durumlarda ödemesi gerektiği hususunda doktrinde ve uygulamada tartışmaların mevcut olduğu anlaşılmıştır. | |
| dc.description.abstract | The aim of the thesis is to investigate the ways of protecting possession, which we frequently apply in our social life and which have some consequences. Since the subject of possession is a difficult concept to understand, explanations have been given in the study primarily about the definition, legal nature, types, acquisition and loss of possession.After understanding the concept of possession, the practices of the ways of protection of possession in Ottoman Law and Roman Law are discussed. In this way, by understanding the practices of the ways of protecting the possession in previous periods, it will be possible to make a more accurate assessment of the ways of protecting the current possession. The ways of protecting the existing possession in our legal system have been discussed separately in detail,, the functions of possession have been examined in order to understand the importance of the protection of possession. Due to the nature and purpose of the study, it is sufficient to compare the movable case and the remuneration case, which are related to the possession cases and are likely to be confused in practice, and these cases have not been examined. As a result of the study, the ways of protecting the possession, which is of great importance in terms of our social life, have been examined in detail. As a result of this study, it was understood that the concept of possession could not be defined clearly and there were discussions about its legal nature. It has been understood that there are discussions in the doctrine and practice about whether the malicious possessor will pay a price due to his/her use of the property, and if he/she will, in which cases he/she should pay. | |
