dc.description.abstractThis work, which was written in a critical approach to Islamic law theory in order to stay away from reductionist approaches and a dichotomous understanding, seems to have been prepared in a multi-faceted manner within the framework of the views prepared in the school system, the existing sources of legal theories. Since understanding the existing parts of the theory means understanding the whole, we can evaluate that the author's critical, multidimensional, systems-based and purpose-oriented approach draws a broad framework for the understanding and interpretation of Islamic legal theory. Within the framework of the fact that Islamic law is an "open" system and that the ijtihad method is still active although some jurists reject it, the Islamic legal system has the function of presenting up-to-date mechanisms by dealing with new events and phenomena without retreating into it’s shell in line with the ijtihad method. Concepts such as maqasid, maslahat, qiyas, and custom are essential methods for the continuation of this system, and it is possible to develop other methods that will contribute to the system. Jasser Auda's work titled Maqasid al-Shariah as Philosophy of Islamic Law A Systems Approach, which we are trying to analyze and evaluate, presents the understanding of Islamic legal philosophy with its methods and offers important evaluations with a critical and contemporary perspective.
dc.description.abstractİndirgemeci yaklaşımlardan ve dikotomik bir anlayıştan uzak durmak suretiyle İslam hukuku kuramına eleştirel bir yaklaşım tarzında telif edilen bu eserin, muhakeme usulü çerçevesinde ekol sistematiğinde hazırlanmış görüşler ve hukuk kuramlarına ait mevcut kaynakların ışığında, yeni yaklaşımlara dair çok yönlü ve kapsamlı hazırlanmış olduğu görülmektedir. Kurama ait mevcut parçaların anlaşılması bütünün anlaşılması anlamına geldiğinden, yazara ait eleştirel, çok boyutlu, sisteme dayalı ve makâsıd yönelimli yaklaşımın İslam hukuk kuramının anlaşılması ve yorumlanması yolunda geniş bir çerçeve çizdiği görülmektedir. İslam hukukunun, içtihat metodunun halen faal olması gerçeği çerçevesinde ve içtihat metodu doğrultusunda kabuğuna çekilmeden, yeni olay ve olguları ele almak suretiyle güncel mekanizmalar ortaya koymak gibi bir işlevi mevcuttur. Makâsıd, maslahat, kıyas, örf gibi kavramlar bu sistemin devamı için elzem metotlar olup sisteme katkı sağlayacak başkaca metotların geliştirilmesi de mümkündür. İncelemeye ve değerlendirmeye çalıştığımız Casir Avde’nin İslam Hukuk Felsefesi-Makâsıdü’ş-Şeriâ (Maqasid al-Shariah as Philosophy of Islamic Law A Systems Approach) adlı eseri eleştirel ve çağdaş bir bakış açısıyla İslam hukuk felsefesi anlayışını yöntemleriyle ortaya koymakta ve önemli değerlendirmeler sunmaktadır.
