Özet
İrade muhtariyeti ilkesi bireylerin hukuki ilişkilerini kendi iradeleri ile hazırlayabilmeleridir. Milletlerarası özel hukuk bakımından irade muhtariyeti kendisini tarafların uygulanacak hukuku seçme özgürlüğü olarak gösterir. Özellikle milletlerarası ticaret hukukunun gelişmesi neticesinde taraflar aralarındaki ilişkiye uygulanacak hukuku önceden bilmek ve hukuki sonuçlarını öngörmek isterler. Bunun yanı sıra yabancı unsurlu sözleşme dışı borç ilişkilerinden doğan uyuşmazlıklarda da irade muhtariyeti ilkesine giderek daha çok yer verildiği görülmektedir. Neredeyse tüm dünyada kabul edilen bir ilke olmasına rağmen, irade muhtariyeti ilkesinin sınırsız olduğundan bahsedemeyiz. Çalışmamızda milletlerarası özel hukukta taraflara tanınan hukuk seçme serbestisinin sınırları ve çeşitli hukuki ilişkiler bakımından gerektirdiği farklı uygulamalar ele alınmıştır. Türk milletlerarası özel hukukunun irade muhtariyeti düzenlemeleri ele alınırken uluslararası sözleşmelerde ve diğer ülkelerde kabul gören hukuki düzenlemeler de göz önünde bulundurulmuştur. Yine çalışmanın bütününde 2675 sayılı Milletlerarası Özel Hukuk ve Usul Hukuku Hakkında Kanun ile 5718 sayılı Milletlerarası Özel Hukuk ve Usul Hukuku Hakkında Kanun'un hukuk seçimi konusundaki düzenlemeleri aralarındaki farklılık ve/veya benzerlikler birlikte değerlendirilmiştir. Çalışmamızın amacı taraf iradelerine hukuk seçimi konusunda imkân tanıyan Milletlerarası Özel Hukuk ve Usul Hukuku Hakkında Kanun'daki düzenlemeler kapsamında irade muhtariyeti ilkesini vurgulamak, bu ilkenin hukukumuzdaki gelişimine ışık tutmaktır.
The principle of party autonomy is that individuals can prepare their legal relations of their own volition. From the point of view of private international law, the head of party autonomy shows itself as the freedom of the parties to choose the applicable law. In particular, as a result of the development of international commercial law, the parties want to know in advance the law that will apply to the relationship between them and predict its legal consequences. In addition, it is seen that the principle of party autonomy is increasingly involved in disputes arising from non-contractual debt relations with foreign elements. Although it is a principle accepted almost all over the world, we cannot mention that the principle of party autonomy is unlimited. In our study, the limits of freedom of choice of law granted to parties in international private law and the different practices required in terms of various legal relations were discussed. The rules of party autonomy of Turkish international private law were considered, while the legal regulations adopted in international conventions and other countries were also taken into account. Again, the private international law and procedural Law No. 2675 in the whole study of international private law and procedural Law No. 5718 on the differences between the regulations of the law on choice of law and/or along with similarities were evaluated. The aim of our study is to emphasize the principle of party autonomy in accordance with the rules in the law on International Private Law and Procedural Law, which allow the will of parties to choose law, and to shed light on the development of this principle in our law.
