Özet
Uluslararası Hukukta ilk kez Birleşmiş Milletler Soykırım Sözleşmesi ile hukuki düzenlemesi yapılan soykırım suçu; millî, etnik, ırkî veya dinî bir grubun, sırf bu özellikleri sebebiyle, kısmen ya da tamamen yok edilmesi amacıyla, sözleşmede sınırlı olarak sayılan fiillerin gruba yönelik işlenmesiyle gerçekleşmektedir. Soykırım Sözleşmesi' ni uygulamalarıyla ve vermiş oldukları kararlarla somut hale getiren, ad hoc mahkemelerinin ve yakın dönemde kurulan Uluslararası Ceza Mahkemesi' nin Statüleri' nde de soykırım suçu, Soykırım Sözleşmesi' ndekine benzer şekilde düzenlenmiştir. Gerek ad hoc mahkemeler gerekse Uluslararası Ceza Divanı' nın kurulması, ağır bir insanlık suçu olan soykırım suçunun yeniden yaşanmaması ve faillerinin yargılanıp cezasız kalmasının önüne geçilmesi adına büyük umut ışığı olmuştur. Türk Ceza Hukuku sistemimizde de, Yeni Ceza Kanunumuzla (5237 s. TCK) soykırım suçu özel olarak düzenlenmiş ve böylece Türkiye Cumhuriyeti Devleti, uluslararası hukuktan kaynaklanan bir yükümlülüğünü gerçekleştirme adına önemli bir adım atmış ve soykırım suçunu önleme ve cezalandırma konusundaki iradesini ortaya koymuştur.
Genocide Crime, regulated with the United Nations Genocide Convention for the first time in the international law, occurs by committing the actions that are listed in partial in the Act against a national, ethnic, racial or religious group in order to exterminate them partially or completely just because of their characteristics. In the statutes of the ad hoc courts and the recently founded International Criminal Court, which materialized the Genocide Act with their practices and verdicts, genocide crime was also regulated in a similar manner to the regulations of the Genocide Act. Founding of the ad hoc courts and the International Criminal Court has become silver lining for preventing genocide crime which is a serious crime against humanity, and for preventing perpetrators from remaining unpunished after trial. In the Turkish Criminal Law system, genocide crime was specially regulated with the New Criminal Code (5237 s. TCK), and thus the Republic of Turkey has taken an important step towards fulfilling the responsibility originated from the international law, and has showed its will in preventing genocide crime and in punishing responsible persons.
