dc.description.abstractMedeni Kanunumuzun yürürlüğe giriş tarihi, henüz çok yeni olduğundan, getirilen yenilikler konusunda, yeteri kadar kaynak eser bulunmamaktadır. Tartışmalı pek çok sorun, hala tam olarak açıklığa kavuşturulmamıştır. Yeni Medeni Kanunumuzla, ailenin korunması amacıyla, eşlerin hukuksal işlem ehliyetlerinin kısıtlanması bilimsel eserlere ve yargı kararlarına yeni yeni konu olmaktadır. Ancak, Medeni Kanunumuzdaki pek çok düzenleme İsviçre Hukukundan alındığından, bizde henüz şekillenen sorunlar, İsviçre'de yıllar önce tartışılmış ve bu konular hakkında çok sayıda bilimsel eser yazılmıştır. Ülkemizdeki, Medeni Kanunla ilgili tartışmalarda ve kaynak kitaplarda bu eserlerden yararlanılmıştır. Bu nedenle tez çalışmamızda, Türk öğretisindeki görüşleri, İsviçre'deki görüşlerle bağlantılı olarak sunmaya çalıştık. Tezde, eşlerin hukuksal işlem ehliyetinin kısıtlanması konusundaki isviçre'deki görüşler ve bunların ülkemizdeki değerlendirmeleri ile değişikliklerin, Türk Toplumunun aile yapısının korunmasına ne şekilde katkıda bulunacağı araştırılmıştır. Tez üç bölümden oluşmaktadır. Birinci bölümde aile konutu ve ev eşyasına ilişkin hukuksal işlemler, ikinci bölümde, evlilik birliğinin korunması amacıyla eşin belirli bir taşınmazı üzerindeki tasarruf yetkisinin kısıtlanması, üçüncü bölümde ise pay devri ile ilgili işlemlerde diğer eşin rızası ve hukuksal işlemin geçerliliğini etkilemeyen rıza konusu incelenmiştir.en_US
dc.description.abstractAs it has been a very short time since the Turkish Civil Law began valid, there are few sources available about the new issues. Many of these issues are still under debate and haven't been clarified, yet. Thorgh new Turkish Civil War, the legal disability of the partners in a marriage has recently been a subject matter for the scientific works or jurisdiction. However many issues which hava been newly appearant for us were debated and became the subject for many scientific works in Switzerland. That's of importance as the very part of our Civil Law was taken from the Swiss Civil Law. Many of these sceintific works, written in Switzerland have also been useful for many debates and source books written in our contry. That's why I tried to present the Turkish Doktirine as related to the Swiss Doctirine I tried to clarify the about the legal disability in Switzerland and in our country. Also tried to illustrate in what ways these changes will these changes will affect and support Turkish familiy life. My thesis involves three parts. In the first part; I studied the legal issues related with the family residence and property. In the second part; I tried to clarify, with the aim of maintainly family unity, the limitation of the legal authority of the partner over the real estate. Finally, in the third and last part; the willigness of the other partner about the share transfer and the that doesn't affect the legal action was studied.en_US
