| dc.description.abstract | Bu çalışmada Osmanlı Devleti’nin ilk modern belediye teşebbüsü olan İstanbul Şehremaneti ele alın-mıştır. Bu müessesenin kuruluş amacı ve usulü, mevzuatı, kendisinden önceki ve sonraki kurumlarla benzerlik ve farklılıkları, amacına ulaşıp ulaşmadığı, hususiyetleri gibi temel konular hukuk tarihi nazarıyla incelenmeye çalışılmıştır. Kuruluşundan kısa bir süre sonra başarısız görülerek âtıl hale gelen bu müessesenin aslında modern belediyeciliğe geçişte çok önemli bir rol üstlendiği, kendisinden sonraki kurumlara pek çok açıdan örnek olduğu görülmüştür. Çalışmada kaynak olarak hukuk tarihine ilişkin bilimsel eserlerin yanı sıra Başkanlık Osmanlı Arşi-vi’nde bulunan vesikalardan yararlanılmıştır. Bugüne kadar ilk kez kullanıldığı düşünülen bir arşiv kaydı ve yapılan bazı tespitler bu çalışmayı özgün kılmaktadır. | |
| dc.description.abstract | In this study, Istanbul Sehremaneti that the first modern municipality of the Ottoman State is discus-sed. Fundamental issues such as the purpose and implementation of this institution, its legislation and whether it has achieved its aims have been examined in terms of legal history. It has been seen that this institution, which became inactive shortly after its establishment, has been featured in the transition to modern municipa-lism and serve as a modal for the following institutions in many respects. In this study, we used besides the scientific works about the law of history and also the documents in the Presidency Ottoman Archive. An archi-ve document (thought to have been used for the first time) used in the study and some determinations make it unique in this way. | |
