Özet
Çalışmamızda, TCK'nın İkinci Kitabının Dördüncü Kısmının, Kamu İdaresinin Güvenilirliğine ve İşleyişine Karşı Suçlar başlıklı Birinci Bölümünde, 260. maddede düzenlenen kamu görevinin terki veya yapılmaması suçu incelenecektir. Öncelikle belirtmek isteriz ki, bu konu ile ilgili kısıtlı sayıda kaynağa ulaşabildik. Bundan dolayı çalışmamızın verimli olmasını umuyoruz. Ayrıca yazarların bu konuya eserlerinde çok fazla değinmediklerini tespit ettik, çalışmamızın bu açıdan faydalı olacağına inanıyoruz.Ülkemizde kamu görevlilerinin çok sık şekilde gerçekleştirdikleri iş bırakma eylemleri, protestolar, grevler veya bunlara benzer başka eylemler sık sık gündeme gelmektedir. Bundan dolayı, ilgili suç tipini inceleme ihtiyacı duyduk.Çalışmamızda, anılan suç tipi ile korunan hukuki yarar, suçun konusu, faili, mağduru ve özellikle suçun seçimlik hareketleri üzerinde durulacaktır. Yine, suçun manevi unsuru ve suçun özel görünüş şekilleri kapsamında değerlendirilmesi yapılacaktır
In our study, Abandonment or Non-execution of Public Duty Offense which is regulated in the second book, part four of Turkish Criminal Code (TCC); Chapter I under the article 260 titled Reliability and Functioning of Public Administration Offenses will be analyzed. Firstly, we wish to state that we have accessed to a limited number of resources related to this topic. For this reason, we hope that our study will be efficient. In addition, we determined that authors have not mention this subject too much in their works, we believe that our study will be useful in this regard.In our country, work stoppages, protests, strikes or other actions like these carried out frequently by public officials come up over and over again. Therefore, we needed to examine the relevant type of crime.In our study; protected legal interest, the subject, perpetrator, victim and particularly alternative acts of aforesaid type of crime will be discoursed. Also, moral element and special appearance forms of crime will be evaluated
