COMPARISON OF ALTERNATIVE DISPUTE RESOLUTIONS IN ISLAMIC LAW TO TURKISH FAMILY LAW

dc.description.abstractThe subject of the study is the legal nature of alternative dispute resolution methods used within the scope of Islamic family law in terms of marriages about to be terminated, and to what extent these methods can be applied in terms of primary and secondary consequences arising as a result of the termination of the marriage. In this study, the methods of conflict resolution and Islamic family law are studied as a part of alternative dispute resolution within the contemporary context. In this respect, mediation and arbitration methods that are planned to be implemented in Turkish family law are adressed with a comparative perspective from the Islamic law approach, a different legal system. The conclusions can be summarized as follows: the scope of alternative dispute resolutions in the Islamic family law covers the end of union of marriage, which is the primary result of divorce. Also, it's impropable to apply mediation or arbitration methods to secondary results due to definitive provisions of the Qur'an and Sunnah, which are considered as main sources of Islamic law. On the other hand, result of conflicts are not taken into consideration within the contemporary mediation and arbitration methods. Instead, these contemporary methods are applied in order to accelerate and ease the process. Therefore, within the scope of contemporary methods, it is improbable to conclude that there is an effort that solely aims to maintain the marriage union. However, in the Islamic family law, it is probable to conclude that the sole aim is to maintain union of marriage and that mediation methods are applied to preserve unity.
dc.description.abstractÇalışmanın konusu, sona ermek üzere olan evlilikler açısından İslam aile hukuku kapsamında gerçekleştirilen alternatif uyuşmazlık çözüm yollarının hukuki tahlilidir. Ayrıca bu faaliyetlerin, boşanma neticesinde ortaya çıkan asli ve fer’i sonuçlar açısından hangi hususlara ilişkin uygulanabileceği de önem arz etmektedir. Çalışma ile İslam aile hukukundaki uyuşmazlık çözüm yöntemleri, pozitif hukuktaki alternatif uyuşmazlık çözüm yolları kapsamında incelenmiştir. Bu doğrultuda yer yer mukayeseli bir bakış açısı ile Türk aile hukukunda uygulanması planlanan arabuluculuk ve tahkim gibi yöntemlere, İslam aile hukuku perspektifinden bakılarak konu farklı bir hukuk sistemi olan İslam hukukunun yaklaşımıyla ele alınmıştır. Varılan sonuçlar şu şekilde özetlenebilir: İslam aile hukukundaki alternatif uyuşmazlık çözüm yollarının kapsamı boşanmanın asli sonucu olan evlilik birliğinin sona ermesi hususunda gerçekleşmektedir. Fer’i sonuçlar üzerinde ise İslam hukukunun asli kaynakları olan Kuran ve Sünnet çerçevesinde tatbik edilen kesin hükümler neticesinde arabuluculuk ya da tahkim faaliyetlerinin gerçekleşmesi mümkün gözükmemektedir. Ayrıca modern anlamda gerçekleştirilen arabuluculuk ve tahkim faaliyetlerinde uyuşmazlığın neticesi ile ilgilenilmeyip sadece sürecin en hızlı ve külfetsiz bir şekilde nihayete ermesi amaçlanmaktadır. Bu bağlamda evlilik birliğinin devamını mutlak surette amaçlayan bir çabadan söz etmek mümkün değildir. İslam aile hukukunda ise yegâne gayenin evlilik birliğinin devamı olduğu ve bu birliğin korunması kapsamında arabuluculuk faaliyetlerinin uygulanmaya çalışıldığını ifade etmek mümkündür.
