| dc.description.abstract | Ceza Muhakemesi Kanunu’nun 183. maddesinde, adliye binası içerisinde ve duruşma başladıktan sonra duruşma salonunda her türlü sesli veya görüntülü kayıt veya nakil olanağı sağlayan aletlerin kullanılmasının yasaklanması düzenlenmiştir. Bu yasağın yaptırımı ise çalışma konumuz olan Türk Ceza Kanunu’nun 286. maddesinde belirlenmiştir. Çalışmada, bu suç ile korunması amaçlanan hukuksal değer incelenecek, suç tipi; suçun konusu, fail, mağdur, suçun maddi unsuru, suçun manevi unsuru, hukuka uygunluk sebepleri, suçun özel görünüş şekilleri ve kovuşturma bağlamında değerlendirilecektir. | en_US |
| dc.description.abstract | In the Article 183 of the Criminal Procedure Code, the prohibition of using equipments that provide recording or transferring all kinds of sound and images; within the courthouse and in the courtroom after the hearing has started, has been regulated. The subject of this study is the sanction of this prohibition, which is determined in Article 286 of the Turkish Penal Code. In this study, the legal value that is intended to be protected by this crime will be examined and the subject of the crime, perpetrator, victim, the material element of the crime, the moral element of the crime, the reasons for compliance with the law, special forms of appearance of the crime and prosecution will be evaluated. | en_US |
