| dc.description.abstract | Ölünceye kadar bakma sözleşmesi yürürlükten kalkan 818 sayılı Borçlar Kanunu'nda ve 6098 sayılı Türk Borçlar Kanunu'nda da düzenlenmiş talih ve tesadüfe bağlı isimli sözleşmelerdendir. Bu sözleşme Türk Borçlar Kanunu'nda yer aldığı için isimli sözleşmelerdendir. Ölünceye kadar bakma sözleşmesi hem Borçlar Hukuku nitelikli hem de Miras Hukuku nitelikli düzenlenebilmektedir. Bu sözleşme ile bakım alacaklısı, bakım borçlusu ile yapmış olduğu sözleşme sayesinde ölünceye kadar bakılmasını sağlamaktadır. Bakım borçlusu da bunun karşılığında bakım alacaklısından bazı malvarlığı değerlerini devralmaktadır. Ölünceye kadar bakma sözleşmesi, tarafların edimleri arasında önemli ölçüde oransızlık bulunması durumunda önel verilerek sona erdirilir. Sözleşmeden doğan borçlara aykırı davranılması veya başka önemli sebeplerle sözleşmenin devamının imkânsız hâle gelmesi ya da güçleşmesi durumda sözleşme önel verilmeksizin feshedilir. | en_US |
| dc.description.abstract | Agreement for lifelong support is from contracts the named which depending on luck and chance, and arranged in No. 818 The Code of Obligations which repealed and in No. 6098 The Turkish Code of Obligations as well. This contract is one of the named contract for be involved in Turkish Obligations Law. Agreement for lifelong support can be arranged both Law of Obligation qualified and Inheritance Law qualified. With this contract, the maintenance creditor is to ensure that he made with care for until death thanks to the agreement signed with the maintenance debtor. The maintenance debtor also is to takes over that some of the values of assets from the maintenance creditor in exchange for this. Until his death look agreement is terminated by be given grace period in the event of there is a significant disproportion between the acts of the parties. Contract is annulled without be given grace period in the event of the continuation of the contract of the impossible to come or to be difficult with the violation of the contractual debt or other important reasons. | en_US |
