| dc.description.abstract | Taşınmaz malikinin, mülkiyet hakkından kaynaklı kullanma, yararlanma ve tasarruf etme yetkileri vardır. Ancak kullanımve yararlanmanın sınırları da söz konusudur. Bu kapsamda kanun koyucu taşınmaz üzerinde geniş yetkiler verdiğimalike kullanım ve yararlanma yetkilerini kullanırken bazı ödevler de yüklemiştir. Bu noktada mülkiyet hakkını taşkınkullanmama yükümlülüğü ve komşular lehine getirilen ödevlere uyma yükümlülüğü söz konusudur. Biz de çalışmamızdamülkiyet hakkının yasal kısıtlamalara aykırı kullanımı halinde ortaya çıkan taşınmaz malikinin sorumluluğumeselesi üzerinde durmaya çalışacağız. | en_US |
| dc.description.abstract | The immovable owner has the power to use, benefit and dispose the property originated from the property right.However, there are also some restrictions on using and benefitting of the property. In this context, the law-makerlaid some duties on the property owner to whom they furnished broad authorities on the immovable when using andbenefitting the property. At this point, obligation of non-excessive usage of the property right and compliance withthe duties put in favor of the neighbors is in question. In our study, we will try to deal with the immovable propertyowner’s responsibility issue as a result of the violating use of property against the legal restrictions. | en_US |
