Özet
Cumhuriyet savcısının takdir yetkisi ba?lığı altında, ilk önce ceza muha-kemesine hâkim olan ilkelerden kovu?turma zorunluluğu ve kamu davasının ihtiyariliği (maslahata uygunluk) ilkeleri üzerinde durulmaktadır. Daha sonra esas inceleme konusu olan Cumhuriyet savcısının takdir yetkisi incelenmek-tedir. Cumhuriyet savcısının takdir yetkisi incelenirken ikili ayrım yapılmak-tadır. Buna göre, ilk önce 5271 sayılı Ceza Muhakemesi Kanunu’nda açıkça düzenlenen takdir yetkisi halleri daha sonra da 5271 sayılı Ceza Muhakeme-si Kanunu’nda düzenlenmeyen ancak maddi ceza hukukunda yer alan bazı kurumlarda Cumhuriyet savcısının takdir yetkisinin bulunup bulunmadığı incelenmektedir
